After two fatal airplane crashes, the Department of Justice brought charges against Boeing employee Mark Forner, alleging that he manipulated and deceived federal regulators in connection with the Boeing 737 Max passenger jets.

Forner’s defense team obtained an acquittal in this high-profile case after less than four days of trial.  In this discussion, defense attorneys David Gerger and Ashlee Martin discussed their successful strategies and drew lessons from the experience pertaining to opening statements and cross examination. Cheryl Scarboro, partner at Simpson Thacher, moderated the discussion.
